NOBL Air™ Terms of use & Liability policy

NOBL Air™ Acceptable Use & Liability Policy 

This section applies specifically to the NOBL Air™ tracking device and any associated NOBL tracking features or app ("NOBL Air™ Services"). By purchasing or activating a NOBL Air™ device, you agree to be bound by the following terms in addition to NOBL Travel's general Terms of Service.

1. Intended Use
NOBL Air™ is designed exclusively to help users locate their own personal belongings including luggage, bags, and other personal property. It is not intended, authorized, or permitted to be used to track any person, individual, or property that does not belong to you.

2. Prohibited Uses
You agree that you will NOT use NOBL Air™ to:

•  Track, monitor, or surveil any person without their explicit, informed consent
• Track property that does not belong to you
• Engage in stalking, harassment, coercive control, or any form of domestic abuse
• Facilitate or assist in any criminal activity
• Place or conceal a device on another person's belongings, vehicle, or property without their knowledge and consent

Violation of any of the above constitutes a material breach of these Terms and may result in immediate termination of your account and access to NOBL Air™ Services.

3. Legal Compliance

Using a tracking device to monitor another person without their consent is illegal in many jurisdictions worldwide, including but not limited to the United States, the United Kingdom, Canada, Australia, and the European Union. It is your sole responsibility to understand and comply with the laws of your country, state, or region before using NOBL Air™.

NOBL Travel operates in full compliance with applicable laws and cooperates with law enforcement agencies upon receipt of valid legal requests. This includes, where legally required, disclosing purchaser information, device registration data, and associated account details to assist in investigations. 

4. Safety Features & Technical Safeguards

NOBL Travel has implemented the following safeguards to deter misuse of NOBL Air™:

• Secure tag pairing: No third party can connect to or access a NOBL Air™ device without the owner's explicit approval. Any unauthorized connection attempt triggers an immediate notification to the registered owner.
• Proximity beep: The owner can trigger an audible alert on the device via the NOBL app to help locate it. 
• Setup acknowledgment: Every user is required to acknowledge, during first-time device activation, that using NOBL Air™ to track another person without their consent is prohibited and illegal.
• Owner registration: Every NOBL Air™ device is linked to a registered account, ensuring that each device in use is traceable to an identified purchaser.

NOBL Travel is committed to continuously improving the safety capabilities of NOBL Air™ in line with evolving industry standards. Additional safeguards, including enhanced protections for non- owners, are under active development.

5. Limitation of Liability for Misuse

NOBL Travel designs and sells NOBL Air™ as a personal belonging tracker. We have no ability to control, monitor, or restrict the physical use of a device once it has been purchased and activated by a user.

NOBL Travel expressly disclaims all liability for any harm, loss, injury, or damage

whether physical, emotional, financial, or otherwise arising from the unauthorized, unlawful, or malicious use of NOBL Air™ by any individual. This includes, without limitation, use of the device for stalking, harassment, or unauthorized surveillance.

By purchasing NOBL Air™, you acknowledge that:

• You are solely responsible for your use of the device
• Any misuse is a violation of these Terms and applicable law
• NOBL Travel bears no responsibility for harms resulting from your misuse

6. Consumer Identification & Account Registration

To purchase and activate NOBL Air™, you are required to create a NOBL account and provide accurate personal information, including your name and email address. This information is retained in accordance with our Privacy Policy.

This registration requirement exists so that:

• Every NOBL Air™ device is traceable to an identified purchaser
• Law enforcement has a lawful avenue to request owner information if a device is used in a crime
• We can enforce these Terms against any user found to be in violation
• NOBL Travel will not sell, share, or disclose this information except as required by law, or as outlined in our Privacy Policy.

7. Reporting Misuse If you believe a NOBL Air™ device is being used to track you without your consent, please:

1. Contact your local law enforcement immediately and provide them with the device if found
2. Email us at hello@nobltravel.com with the subject line "NOBL Air Misuse Report"
3. NOBL Travel will cooperate fully with any resulting law enforcement inquiry

8. Updates to This Policy

NOBL Travel reserves the right to update this policy at any time. Continued use of NOBL Air™ Services following any update constitutes acceptance of the revised terms.
